Terms of Service

1. Agreement

By creating a SurfPing account, you agree to these Terms of Service and our Privacy Policy.

2. Service description

SurfPing provides personalised surf condition alerts for Australian beaches. We analyse forecast data from Open-Meteo (powered by ECMWF) and match it against your preferences to notify you when conditions look good.

3. Accounts

  • You must provide a valid email address to create an account
  • One account per person
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 16 years old to use SurfPing

4. Subscription and payment

  • Free tier: limited dashboard access (blurred session times and match timeline)
  • Pro tier: $5 AUD per month, includes a 30-day free trial (one trial per customer)
  • Payment is processed securely by Stripe
  • Your subscription automatically renews each month unless cancelled
  • You will be charged on the same date each month (or the last day of shorter months)

5. Cancellation

  • You can cancel your subscription at any time from Settings → Manage Billing
  • Cancellation takes effect at the end of your current billing period — you keep Pro access until then
  • No refunds for partial billing periods, except where required by Australian Consumer Law
  • After cancellation, your account reverts to the free tier (your beaches and preferences are preserved)

6. Free trial

  • New users are eligible for one 30-day free trial of the Pro tier
  • The trial is limited to one per customer — if you have previously had a trial or paid subscription, you are not eligible for another trial
  • You can cancel during the trial period without being charged

7. Forecast data disclaimer

  • Surf condition forecasts are generated from third-party data (Open-Meteo/ECMWF) and are estimates only
  • Actual conditions may differ significantly from forecasts
  • SurfPing does not guarantee the accuracy, completeness, or timeliness of any forecast data
  • Always check actual conditions before entering the water
  • SurfPing is not a substitute for personal judgement, local knowledge, or official safety warnings

8. Limitation of liability

  • To the maximum extent permitted by Australian law, SurfPing is not liable for any loss, injury, or damage arising from your use of the service or reliance on forecast data
  • This includes but is not limited to: personal injury, property damage, missed surf sessions, or decisions made based on alerts
  • Nothing in these terms excludes or limits consumer guarantees under the Australian Consumer Law that cannot be excluded by law

9. Acceptable use

You agree not to:

  • Share your account credentials with others
  • Use automated tools to scrape or abuse the API
  • Attempt to circumvent subscription restrictions
  • Use the service for any unlawful purpose

10. Account deletion

  • You can permanently delete your account at any time from Settings
  • Deletion removes all your data including beaches, preferences, alert history, and authentication credentials
  • If you have an active subscription, it will be cancelled and no further charges will occur
  • Account deletion is irreversible

11. Changes to these terms

We may update these terms from time to time. We will notify you of material changes by email at least 30 days before they take effect. Continued use of SurfPing after changes take effect constitutes acceptance of the updated terms.

12. Governing law

These terms are governed by the laws of Australia. Any disputes will be resolved in the courts of Australia.
